INTRODUCTION
The following Gameplay Rules (“Rules”) are considered part of Bankroll U’s Terms of Service (“Terms”), which constitute a legally binding agreement between you (referred to herein as “you,” “your,” “user,” or “participant”) and Bankroll U LLC (“Bankroll U,” “Company,” “we,” “us,” or “our”). By agreeing to these Rules and participating in Gameplay (defined below), you are confirming that you understand and accept these Rules. To participate in Gameplay, you must maintain an active Account with Bankroll U and agree to Bankroll U’s Terms, which incorporate these Rules, the Official Contest Rules, and our Privacy Policy.
These Rules govern Gameplay on Bankroll U’s Service. All capitalized terms and phrases not otherwise defined in these Rules shall have the meanings given in the Terms and/or Official Contest Rules. In the event of a direct conflict or inconsistency between these Rules, the Terms, or the Contest Rules, the Contest Rules shall prevail, followed by these Rules, followed by the Terms.
Bankroll U reserves the right to change or modify Gameplay on the Service at any time and in our sole and absolute discretion, including without limitation the right to amend, edit, and/or supplement these Rules, or any part of these Rules, by posting the updated Rules and updating the “Last updated” date at the beginning of these Rules. By continuing to participate in Gameplay at any point after such an update, you agree to the updated Rules. We encourage you to review these Rules frequently to check for updates. If you do not agree to the updated Rules, you may not participate in Gameplay.
The decisions of Bankroll U are final and binding in all matters related to Gameplay, including without limitation, access, participation, operation, and resolution.
PRODUCT COMPONENTS RELEVANT TO GAMEPLAY
The Bankroll Combine; Combine Tiers
The Company offers an immersive training simulation for sports market predictions (the “Bankroll Combine”) where users are prompted to develop and demonstrate skills in sports market handicapping and bankroll management. Each Bankroll Combine includes three components:
- The Combine Challenge: a skill-based challenge conducted in our sports market simulator;
- The Combine Bankroll: a balance of virtual funds users manage throughout the Combine Challenge; and
- Tuition Points: content credits used to access learning modules and tools throughout the Service.
In the combine Challenge users are presented with a set of performance targets prompting them to make decisions for allocating the virtual funds in their Combine Bankroll (each decision, a “Pick”). Picks are submitted in the “Games” module, a sports market simulator with real-time prices/odds for upcoming and live sporting events. To supplement skill development, users can spend their Tuition Points for access to various instructional courses or to unlock analysis and insights from experienced handicappers.
To accommodate a range of user preferences, we offer several distinct Combine tiers. Through your Account, you can purchase any offered Combine tier (each purchase, a "Combine Entry"). For each Combine Entry purchase, your Account will be credited with the specified number of Tuition Points and the corresponding Combine Bankroll balance for the selected Combine tier, as designated on the Website.
Tuition Points
Each Combine Entry includes a designated quantity of Tuition Points that are automatically credited to your Account upon purchase. Your available balance of Tuition Points is displayed in your Account. Tuition Points can only be spent within the Service. Each item redeemable with Tuition Points throughout the Service displays a redemption price expressed in Tuition Points. Upon redemption of an item your available balance of Tuition Points will be adjusted automatically (provided that your Account contains a sufficient balance of Tuition Points to redeem the selected item). Users are encouraged to explore the Campus and other modules regularly for updates to available offerings and to spend Tuition Points on items most aligned with their learning and development goals.
Tuition points are exclusively for accessing learning content and tools. They hold no cash value, are not redeemable or exchangeable for cash or any cash equivalent, and cannot be utilized to gain entry into any challenge or contest offered through the Service.
The Combine Challenge
Each Combine Entry grants the user a Combine Bankroll, which is used for participation in the Combine Challenge. The balance of the Combine Bankroll credited to your Account corresponds to the number of Tuition Points associated with the specific Combine tier purchased. In the Combine Challenge, users are presented with a set of requirements that performance will be graded against. Failure to meet all requirements of the Combine Challenge results in the removal of the associated Combine Bankroll from the user's Account. Successful completion of the Combine Challenge earns an eligible user the opportunity to participate in a free prediction-based contest game offered by the Company. Regardless of the outcome of any challenge or contest, users retain any remaining balance of Tuition Points in their Account.
Pro Levels; Prizes
The Company offers a free skill-based prediction contest where eligible users can play for real-cash prizes (the “Pro Levels”). After successfully completing the Combine Challenge, to participate in the Pro Levels an eligible user must agree to the terms of the Official Contest Rules. Upon entry to the Pro Levels, the associated Combine Bankroll will be removed from the user’s Account and replaced with a separate balance of virtual funds (a “Pro Bankroll”), as designated on the Website. In the Pro Levels, users manage the allocation of their Pro Bankroll across a series of progressive stages by submitting Picks in the Games module. Each Pro Level presents a distinct prize opportunity and a set of requirements that must be satisfied for such prize to be awarded. Access to Pro Levels and Pro Bankrolls cannot be purchased, they are provided for free to qualifying users based exclusively on performance in the Combine Challenge.
Each Pro Level can only be attempted and completed sequentially (advancement to a subsequent Pro Level is contingent on successful completion of the prior). When a Pro Level is successfully completed––meaning all applicable requirements have been graded as satisfied––the corresponding prize for that Pro Level is automatically calculated and transferred into the digital “Prize Wallet” linked to the user’s Account (each such transfer, a “Prize Transfer”). Prize Transfers occur automatically following the successful completion of a Pro Level and are deducted from the balance of the corresponding Bankroll prior to the commencement of the next Pro Level (if any remain). A user’s Prize Wallet balance is displayed in their Account.
Participation in the Pro Levels is terminated when a user fails to satisfy the requirement(s) of a Pro Level or when a user successfully completes the final Pro Level. Upon termination of participation in the Pro Levels the associated Pro Bankroll will be removed from such user’s Account, however the user remains entitled to any prizes already awarded for completion of prior Pro Level(s).
Access to the Pro Level(s) is neither guaranteed by the purchase of a Bankroll Combine nor guaranteed through participation in a Bankroll Combine. All matters relating to participation in the Pro Levels and prize redemptions are subject to the Official Contest Rules.
Bankrolls and Virtual Funds
Combine Bankrolls and Pro Bankrolls refer to distinct balances of virtual funds provided by the Company for eligible users to manage, however when referred to generally each are a “Bankroll” or “Bankroll Funds.” Any Bankrolls provided by the Company are strictly for educational and entertainment purposes and to facilitate participation in skill-based challenges or contests offered by the Company; no real-money wagering occurs on the Service. The Service does not offer any mechanism for users to deposit funds or stake Picks with real money. User Picks can only be submitted in the Games module using virtual funds provided by the Company and users do not encounter any real-money risk for losing Picks.
A user may manage up to three (3) active Bankrolls in their Account simultaneously. When multiple Bankrolls are managed simultaneously, the transaction history and level grading for each Bankroll are maintained separately.
GAMEPLAY
“Gameplay” refers to interaction and/or participation in any Combine Level or Pro Level, including without limitation, any interaction with the Games module, the “My Picks” module, the Prize Wallet, and/or any interaction with any Combine Bankroll or Pro Bankroll. By participating in Gameplay, you agree to be bound by these Rules, the Terms, the Official Contest Rules (where applicable), and our Privacy Policy and further agree that the decisions of the Company are final and binding in all matters related to Gameplay.
Conditions of Participation
The Company reserves the right, in its sole discretion and without prior notice, to modify any aspect Gameplay, including without limitation, the requirements presented by any Combine Challenge or Pro Level (when referred to generally and without designation, each a “level”), the number, structure, and progression of levels, the manner in which levels are graded, the prize opportunities associated with levels (if any), and the rules and/or limits imposed on Picks, events, offerings, levels, or other Gameplay matters. Participation in Gameplay must be for the sole and specific purposes of education, recreation, and entertainment only. You may not participate in Gameplay for other purposes (including without limitation professional, commercial, or related purposes) and may not use automated or other systematic methods to participate in Gameplay. You may not participate in Gameplay in concert with other participants. Any deliberate attempt to undermine or manipulate the legitimate operation of Gameplay may be considered a violation of law. In such cases, the Company reserves the right to seek damages from the responsible party to the fullest extent permitted by law. Failure to enforce any provision of these Rules does not constitute a waiver of such provision.
The Company reserves the right, in its sole discretion, to deny any user the ability to participate in Gameplay, or any portion or component thereof, for any reason whatsoever. The Company shall be entitled to terminate or suspend your Account, disqualify you from a Pick, level, or level advancement, refuse to award benefits or prizes, virtual or otherwise, and require the return of any prizes if we determine, in our sole discretion, that you are entering, participating, or attempting to enter or participate in Gameplay in any manner the Company deems to be improper, unfair, or otherwise adverse to the operation of the Gameplay or is in any way detrimental to other Gameplay participants. The Company reserves the right, in its sole discretion, and without prior notice, to take any action necessary to remedy any balance(s), transaction(s), level advancement(s), or related components associated with your Account that we deem to be improper, inaccurate, or unfair, including without limitation, any reversal, adjustment, deduction, or voiding of any Picks, level advancements, Bankroll Funds, Tuition Points, or prizes credited to your Account. The Company reserves the right, in its sole discretion and for any reason whatsoever, to impose limits and/or rules on any component of Gameplay and to add, remove, or amend such limits or rules without prior notice at any time it deems necessary.
To the extent the Service displays odds, markets, scoring and/or statistics for upcoming, live, or past events, all such information and any related components are offered for informational and/or entertainment purposes only. Neither the Company nor its third-party providers warrant or make any representations of any kind with respect to the information provided through the Service and related information sources. The Company and its third-party providers shall not be responsible or liable for the accuracy, usefulness, or availability of any information transmitted or made available via the Service and related information sources, and shall not be responsible or liable for any error or omissions in that information.
If you do not agree to these conditions you may not participate in Gameplay.
Gameplay Definitions
Activity Target. An in-level minimum aggregate amount of Bankroll Funds that must be allocated to Settled Picks in order to satisfy an activity requirement for a level.
Available Balance. The balance of virtual funds in a Bankroll that are available for Pick submission.
End Balance. An in-level term referring to the balance of virtual funds in a Bankroll upon the conclusion of a particular level.
Error. For purposes of Pick submission, acceptance, settlement, and/or grading, with respect to the Service, the Company, and any third-party services engaged by the Company to facilitate the Service, a mistake, misprint, misinterpretation, mishearing, misreading, mistranslation, spelling mistake, technical hazard, registration error, transaction error, manifest error, force majeure, and/or similar occurrence. Examples of Errors include but are not limited to: (i) Picks accepted during technical problems that would otherwise not have been accepted; (ii) Picks placed on events or offerings that have already been decided; (iii) Picks on odds containing incorrect event participants; (iv) Picks placed at odds materially different from those available in the general market at the time the Pick was placed; (v) Picks offered at odds which reflect an incorrect score and/or situation; and (vi) Picks accepted with odds that are clearly incorrect given the chance of the associated event outcome occurring at the time the Pick was placed.
Event. A single discrete sporting contest, game, match, or similar from which one or more market offerings may be available in the Games module. Where Pick limits reference a per-Event threshold, all Picks sharing the same Event are aggregated for purposes of applying that limit.
In-Level. A descriptor signaling that a particular balance, metric, calculation, object, or similar corresponds only to intra-level activity and not inter-level activity.
In-Level Profit / Loss. With respect to a level’s Profit Target, Loss Limit, or to a Performance Bonus calculation, the total amount won from Settled Picks less the total amount lost from Settled Picks within the level (a positive result indicates In-Level Profit; a negative result indicates In-Level Loss).
Initial Account Size / Initial Balance. The balance of virtual Bankroll Funds provided by the Company at the time such Bankroll is added to a user’s Account, corresponding to the Combine tier purchased or obtained. Pick limits and/or level targets expressed as a percentage of Initial Account Size are calculated based on this figure and remain fixed for the life of the associated Bankroll, regardless of subsequent balance changes.
Loss Limit. The maximum In-Level Loss (in-level net loss) permitted before a level failure is triggered. Compliance with the Loss Limit may be evaluated and enforced in real time or at scheduled intervals as determined by the Company. A Bankroll equaling or exceeding the designated Loss Limit at the time of evaluation will trigger level failure.
Max Risk per Pick. The maximum amount of Bankroll Funds that can be allocated to a single Pick. Distinct thresholds may apply depending on the type of Pick (i.e. Pregame Pick, Live Pick, Prop Pick) as set forth in the Gameplay Parameters Table. Max Risk per Pick is superseded by limits for Max Win and Max Risk per Event.
Max Risk per Event. The maximum aggregate amount of Bankroll Funds that may be placed at risk across all Picks relating to the same Event, as set forth in the Gameplay Parameters Table. The Max Risk per Event limit supersedes per-Pick limits: even if an individual Pick would otherwise be permissible under its applicable Max Pick Risk threshold, it may not be submitted if doing so would cause the total risk on that Event to exceed the Max Risk per Event threshold.
Max Win per Pick. The maximum amount of Bankroll Funds that can be gained from a single winning Pick outcome.
Odds l;imits. The maximum or minimum odds permitted for Pick submission (e.g. a Short Odds limit of -500 means Picks may not be submitted at odds shorter than -500).
Open Pick. A submitted and accepted Pick awaiting assignment of an outcome. Level completion will not trigger while Open Pick(s) remain outstanding: even if all other requirements are satisfied for level completion, grading will not be triggered until there are no outstanding Open Picks (this applies to all levels except the final Pro Level).
Payout. The amount of Bankroll Funds credited to a corresponding Bankroll following a winning Pick, calculated as the sum of the amount risked and the amount won.
Performance Bonus. The prize awarded to a user upon successful completion of a Pro Level, as set forth in the Gameplay Parameters Table.
Pick Stacking. A prohibited act where multiple Picks from the same Bankroll are submitted for the same event outcome.
Pregame Pick. A Pick submitted and accepted before the start of an Event for standard markets (moneyline, spread, or total).
Profit Target. A minimum amount of In-Level Profit that must be achieved in order to satisfy a profit requirement for a particular level. A Profit Target may be expressed as a percentage of Level Start Balance or as an integer depending on context.
Push. A Pick that results in a tied outcome, causing the amount of Bankroll Funds submitted for the Pick to be refunded to the Bankroll. The amount submitted for a Pick that results in a Push counts toward the corresponding Activity Target.
Settled Pick. A Pick with an outcome that has been determined and to which a Settlement has been applied.
Settlement. The assignment of an outcome to a submitted Pick (e.g., win, loss, push) and the corresponding adjustment (if any) to the Available Balance of the Bankroll from which such Pick was submitted.
Start Balance / Level Start Balance. An in-level term referring to the balance of virtual Bankroll Funds in a Bankroll at the beginning of a particular level. For the Combine level and the initial Pro Level, the Start Balance equals the Initial Account Size. For all subsequent Pro Levels, the Start Balance equals the End Balance from the prior level less the Performance Bonus deduction from the prior level.
Time Limit. The total number of days a user has to complete a challenge or contest, or a designated level of a challenge or contest, as set forth in the Gameplay Parameters Table. A user who does not satisfy an applicable requirement within the stated Time Limit will be deemed to have failed any outstanding level(s) of the associated challenge or contest.
Pick Submission
The Games module will display the available sports market offerings. To submit a Pick, select a market offering, review the odds, and input an eligible amount of your Available Balance. When you submit a Pick, the listed amount of Bankroll Funds will be debited from the Available Balance of the corresponding Bankroll. All Pick submissions and related data are the property of the Company. All submitted Picks are subject to the Max Win and Max Risk limits set forth in the Gameplay Parameters Table (Max Win per Pick supersedes Max Risk per Pick). Limits applicable to a single Pick vary by Pick type (e.g., Pregame, Live, or Prop). The Max Risk per Event limit applies in aggregate across all Picks on the same Event and supersedes individual Pick-type limits.
A Pick submission is not valid until it appears in the “My Picks” section for the corresponding Bankroll. All Pick submissions will be deemed submitted by the person in whose name the Account was registered. It is the responsibility of the Account holder to ensure the details of submitted Picks are correct. The Company is not responsible for incomplete, misdirected, incorrect, or otherwise mistaken Pick submissions. The Company is not responsible for any Pick submission mistakes (perceived and actual) deriving from Errors or incorrect listings for the odds, events, timing, and/or objects associated with a market. Should a dispute arise about the submission (or lack thereof) of any Pick or related transaction in a user’s Account, the decision(s) of the Company shall be the sole and ultimate authority in resolving such matters.
Event Results; Pick Grading
Event results and virtual winnings calculations are based on the final statistics and scoring results at the completion of each individual event. Once event results are reviewed and graded, virtual payouts, winnings, and/or refunds are credited to corresponding Bankrolls (Pick amounts, winnings calculations, payout calculations, refund calculations, Performance Bonuses, Prize Transfer calculations, and/or Bankroll balances may be rounded to the nearest whole number). The scoring results of an event will not be changed regardless of any official statistics or scoring adjustments made by the leagues at later times or dates, except in the Company’s sole discretion. The Company and its third-party providers shall not be responsible or liable for the accuracy, availability, or timeliness of any event result or associated Pick grading and shall not be responsible or liable for any error or omissions in that information. The Company may, in its sole discretion, invalidate any event result for purposes of preventing any abusive or unfair activity. Should a dispute arise relating to event results or Pick grading, the decision(s) of the Company shall be the sole and ultimate authority in resolving such matters.
Voiding of Picks
The Company reserves the right, in its sole discretion, to declare any Pick void, entirely or partly, in the event:
(i) a Pick has been offered, placed or accepted due to Error; or
(ii) the Company deems a Pick to be in furtherance of conduct improper, unfair or otherwise adverse to the operation of the Gameplay or in any way detrimental to other Gameplay participants.
A Pick can be voided retroactively, regardless of whether it has been settled or not. In the event a Pick is voided, the Company reserves the right, in its sole discretion, to adjust any corresponding Payout, balance of Bankroll Funds, and/or prize(s) credited to a user’s Account.
Gameplay Tools
To the extent the Service offers or displays dashboards, leaderboards, charts, graphs, statistics, analysis, reports, or similar tools for tracking Gameplay progress or summarizing Gameplay results, whether on an individual or aggregated basis, all such information and any related components are offered for informational and/or entertainment purposes only. Neither the Company nor its third-party providers warrant or make any representations of any kind with respect to the information provided through the Service and related information sources. The Company and its third-party providers shall not be responsible or liable for the accuracy, usefulness, or availability of any information transmitted or made available via the Service and related information sources, and shall not be responsible or liable for any error or omissions in that information.
Ownership and Use of Gameplay Data
By participating in Gameplay, you acknowledge and agree that all data generated through your interaction with the Service, including without limitation, gameplay statistics, Pick and related transaction history, user behavior and/or haptics, and any other information collected during Gameplay is the sole property of the Company. Subject to the terms of our Privacy Policy, the Company reserves the right, in its sole discretion and without notice, to collect, store, reproduce, analyze, package, sell, license, distribute or otherwise use Gameplay data for any internal or commercial purpose.
Level Grading
A level failure is triggered if a user: (i) fails to satisfy the applicable level requirements within the Time Target; or (ii) incurs In-Level Losses that equal or exceed the In-Level Loss Limit at the time of evaluation. For all levels except the final Pro Level, grading for level completion is not triggered unless no Open Picks remain outstanding. When grading for level completion is triggered, a level is considered successfully completed when all applicable level requirements are satisfied (Activity Target, Profit Target, and any other applicable requirements). Grading for completion of the final Pro Level will be triggered upon satisfaction of all applicable level requirements without respect to outstanding Open Picks, which are voided upon successful completion. The Company shall not be responsible or liable for the accuracy or timeliness of any level grading. It is the responsibility of users to monitor their progress against all applicable level requirements and limits. Should a dispute arise about level grading, the decision(s) of the Company shall be the sole and ultimate authority in resolving such matters.
